Might want to change this - he was misquoted. He said he would stand with Harlan in dissent of Plessy v Ferguson and that the 14th amendment prevents racial discrimination.

Also on the stance of "originalism" just for the sake of argument it was the Orginalists on the court that stood with Johnson (Texas v Johnson) that held that flag burning is protected political speech.

Scalia was in the majority. Originalism is not always the boogie-man you are making it out to be.
